In
the context of the KCIL efforts to set up a knowledgeable ground for
familiarizing Kurdistan's Peshmerga forces with international humanitarian law,
a two-day workshop was conducted on August 20-21,
2024, for 22 high-ranking officers in Erbil Governorate. This workshop was coordinated in cooperation with the Ministry of
Peshmerga Affairs (MOPA) - Directorate of Media and National Awareness. The overreaching
aim of this activity was to acquaint the participating commanders with the core
principles of international humanitarian law (IHL) and to expand their legal
perspective during armed conflicts by using international legal sources and
applicable national military laws in guiding military confrontations.
On
the first day, Dr. Twana Abdulrahman introduced the participants to the KCIL
legal manual, which is specific to the armed conflicts of the Kurdistan Peshmerga forces. This segment of the
workshop focused on the manual's content and how to use its legal guidelines
during military conflicts. Furthermore, participants presented their viewpoints
on the manual, discussing methods for disseminating
the information it provides among the forces affiliated with the MOPA, all of
which are derived from international laws and
conventions in the field of IHL. In the afternoon, Dr. Karmanj Osman, a legal
advisor at the KRI Ministry of Justice, delivered a session named " Types
of Crimes in IHL." Subsequently, a debate session was
held on the topic. The officers shared their experiences from the
battlefronts and their adherence to humanitarian values, which later became
intertwined with given information which Dr. Karmanj Osman as delivered.
At
the start of the final day, Dr. Mohammad Rashid familiarized the participants
with the principles of excluding criminal responsibility in international laws,
alongside discussing a sort of historical events related to crimes committed
during international and domestic wars, aimed at further enriching the content
of the topic. Subsequently, Dr. Shiraz Ibrahim, within the framework of a
presentation, explained the principles of IHL from its fundamental concepts
namely distinction, proportionality, and necessity, in the context of armed
conflicts. The final session of the workshop, presented by Dr. Hassan Hussein, was dedicated to IHL in the era of artificial
intelligence. This session highlighted the latest developments in AI military
industries that precisely affect the implementation of IHL in settle military
conflicts at both domestic and international levels.
The
workshop concluded with the presence of the Secretary-General of the Ministry
of Peshmerga Affairs (Major General Bakhtiar Mohammad), the Director of Media
and National Awareness at the Ministry of Peshmerga Affairs (Major General
Othman Mohammad Mustafa), and the representative of the German Federal Military
Advisor in the Kurdistan Region (Major Matthias). Following their brief
speeches about the workshop, they expressed hope for the continuity of the KCIL
activities in this field to pave the way for further efforts in organizing
similar activities for the Peshmerga forces. In the presence of the officials,
participants taken their certificates of participation and concluded with
closing remarks.
